DLBP secures the discharge of difficult conditions to allow care home development to proceed on time

Location:
Rushcliffe Borough Council

Issue:
Securing the discharge of conditions on a site forming part of a wider development with a complex planning history.

How we helped and added value:
Our client approached us to assist with discharging the planning conditions on a site it had purchased with planning permission for an 80 bedroom care home. The site was part of a wider development comprising a supermarket and a further parcel identified for extra care development. The site also had a complex planning history, including several permissions varying conditions.

Our work here first focused on identifying the correct conditions for the client to discharge, so it could progress with the permission it wished to develop. We then advised the client on the requirements for discharging these conditions, including requirements for conditions that the client had not previously encountered on other sites.

We then worked closely with the Council to ensure these conditions could be discharged quickly, to allow development of the home to start on-time.
