DLBP acts to remove to CIL liability for scheme

Our client had secured permission the conversion of a building into apartments in Berkshire but had subsequently received a CIL Liability Notice from the Council setting out that the scheme was liable for payment. The Council claimed this was because there was no evidence in the application that the building had been in its lawful use for a period of six months in the previous three years. 

DLBP were instructed to advise and we were able to procure a range of documentary evidence to issue to the Council that provided that the building, which our client had acquired with vacant possession, had in fact been lawfully used as an office and so no CIL was liable.  This has removed a potentially significant financial burden.
